Terms of Service

1. Agreement

By creating an account or using any TextraHost service, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. These terms apply to all users of textrahost.com and its APIs.

2. Services

TextraHost provides KVM-based virtual private server (VPS) hosting and related services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice. Service specifications are as described at the time of purchase.

3. Identity Verification

To prevent fraud and abuse, identity verification is required to use our services. Before an order is activated, you agree to complete our identity verification process and to provide accurate, valid, government-issued identification along with any additional documentation we may reasonably request. We may delay, suspend, or refuse activation — and may terminate an existing account without refund — if verification cannot be completed, is declined, or if the information you provide is found to be false, incomplete, or fraudulent. Any information collected for verification is handled in accordance with our Privacy Policy.

4. Account Responsibilities

You are responsible for: - Maintaining the security of your account credentials - All activity that occurs under your account - Ensuring your use complies with our Acceptable Use Policy - Keeping your billing information current and accurate - Any content you deploy on our infrastructure

5. Billing & Payment

Plans are billed in advance on a 1-month, 1-year, or 3-year basis depending on the term selected. Payments are non-refundable except during our 14-day money-back guarantee period for new customers. Failed payments may result in service suspension. Price Lock Guarantee applies only to the billing term in effect at time of signup.

6. Refund Policy

New customers may request a full refund within 14 days of first signup. After 14 days, payments are non-refundable. Refunds for service credits due to verified downtime below our SLA are issued as account credit, not cash. Refunds are not available for accounts suspended or terminated due to violations of our Terms of Service, Acceptable Use Policy, spam activities, abuse complaints, fraudulent activity, or illegal usage.

7. Service Level Agreement (SLA)

We guarantee 99.9% monthly uptime for VPS instances. Downtime is calculated as consecutive minutes of complete inaccessibility. SLA credits of 10x the duration of verified downtime (up to 100% of monthly fee) will be applied as account credit upon request.

8. Prohibited Activities

Use of our services for prohibited activities (as detailed in our Acceptable Use Policy) will result in immediate termination without refund. Prohibited activities include but are not limited to: spam, DDoS attacks, hosting illegal content, and cryptocurrency mining.

9. Limitation of Liability

TextraHost's total liability for any claim arising out of or related to these terms or our services shall not exceed the amount paid by you for the service in the 3 months prior to the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Customers may cancel their services at any time through the client portal or by submitting a cancellation request. For Shared Hosting services, either party may terminate the service with 30 days written notice where applicable. For VPS services, unpaid invoices may result in service suspension on the due date. VPS services that remain unpaid for more than 7 days after suspension may be permanently terminated and all associated data, backups, snapshots, and configurations may be permanently deleted without further notice. TextraHost is under no obligation to retain or recover data after service termination due to non-payment. TextraHost reserves the right to immediately suspend or terminate any service without prior notice in cases involving spam, phishing, malware distribution, illegal activities, fraud, abuse complaints, violations of our Terms of Service, or violations of our Acceptable Use Policy. In cases where a service is terminated due to illegal activities, abuse, or Terms of Service violations, TextraHost may immediately remove and permanently delete all associated data without providing backups, recovery services, refunds, credits, or compensation of any kind. Customers are solely responsible for maintaining their own backups at all times.

11. Governing Law

These terms are governed by the laws of India. Any disputes shall be resolved in the courts at Bokaro Steel City, Jharkhand.

12. KYC Verification

13. Illegal Activities

We reserve the right to suspend or terminate any service immediately and without prior notice if we determine that our servers are being used for spamming, illegal activities, or any violation of our Terms of Service. Following such action, we are under no obligation to provide data backups or recovery services. Users are solely responsible for maintaining their own backups and ensuring the security and legality of the content and activities conducted through their accounts. we shall not be liable for providing any refund

14. About Backups

Backups are not included by default with our VPS services. Customers may purchase backup services separately if required. We do not accept responsibility for any data loss, corruption, accidental deletion, hardware failure, security incidents, or any other event affecting server data or availability. Customers are solely responsible for maintaining their own backups and ensuring the safety, integrity, and availability of their data at all times. In the event of data loss or any incident affecting customer data, we shall not be liable for providing any refund, compensation, or damages of any kind, regardless of the cause of the incident.

15. Unmanaged Service Disclaimer

This is extremely important Our all VPS is unmanaged. Unless explicitly purchased as a managed service by Contacting us, all VPS services are provided on an unmanaged basis. Customers are solely responsible for server administration, software installation, updates, security hardening, firewall configuration, backups, and troubleshooting.

16. Resource Abuse Policy

Customers may not use excessive CPU, RAM, disk I/O, network bandwidth, or other resources in a manner that negatively impacts the stability or performance of the infrastructure or other customers. TextraHost reserves the right to limit, suspend, or terminate services causing such issues.

17. Hardware and Network Failures

While TextraHost uses enterprise-grade hardware, redundant networking, and industry-standard practices to provide reliable services, hardware failures, storage failures, network interruptions, datacenter incidents, DDoS attacks, software issues, and other unforeseen events may occur and are considered an inherent risk of hosting services. TextraHost shall not be held responsible for any loss of data, corruption of data, business interruption, loss of profits, or any damages resulting from such incidents. Customers are solely responsible for maintaining their own backups regardless of whether backup services are purchased from TextraHost or maintained independently. In the event of hardware failure or any incident affecting customer data, TextraHost may attempt data recovery or restoration on a best-effort basis where backups are available. However, TextraHost does not guarantee the availability, integrity, or recoverability of any customer data or backups. If backups are available, we may provide them to the customer where technically possible. If backups are unavailable, corrupted, incomplete, or unrecoverable, TextraHost shall not be liable for providing compensation, refunds, damages, or any form of reimbursement arising from the loss of such data.

18. Operating System Reloads

Any operating system reinstallation, template deployment, or disk reset requested by the customer will permanently erase existing data. Customers are responsible for maintaining backups prior to requesting such actions.

19. IP Reputation and Blacklisting

Customers are responsible for maintaining the reputation of their assigned IP addresses. Services involved in spam, phishing, malware distribution, or activities resulting in IP blacklisting may be suspended immediately without refund.

20. Abandoned Services

Services suspended due to non-payment may be permanently deleted vps/dedicated server, etc.. after 7 days. TextraHost is under no obligation to retain customer data after this period.
